1. Acceptance of Terms

By accessing or using the DataCrux.ai website and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Services.

These Terms constitute a legally binding agreement between you and DataCrux Technologies Pvt. Ltd. ("DataCrux," "we," "our," or "us").

2. Description of Services

DataCrux.ai provides an AI-powered data discovery, consent management, and privacy compliance platform. Our Services include the web application, APIs, documentation, and related tools.

3. Account Registration

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity under your account.

4. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose
• Attempt to gain unauthorized access to our systems or data
• Interfere with or disrupt the Services
• Reverse engineer, decompile, or disassemble the Services
• Use the Services to process data in violation of applicable privacy laws
• Resell or redistribute the Services without our written consent

5. Data Processing

When you use our Services to process personal data, you act as the Data Fiduciary/Controller and we act as the Data Processor. Our data processing obligations are governed by a separate Data Processing Agreement (DPA), which forms part of these Terms.

6. Intellectual Property

The Services, including all content, features, and functionality, are owned by DataCrux and are protected by intellectual property laws. You retain ownership of your data. We claim no rights over the data you process through our Services.

7. Payment Terms

Paid Services are billed in advance on a subscription basis. Fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice.

8. Service Level Agreement

Enterprise customers may be eligible for a separate SLA with guaranteed uptime and support response times. Contact our sales team for details.

9. Limitation of Liability

To the maximum extent permitted by law, DataCrux shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services.

10. Termination

Either party may terminate the agreement with 30 days' written notice. We may suspend or terminate your access immediately if you violate these Terms. Upon termination, you may request export of your data within 30 days.

11. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
